1. Scope and conditions of application

These terms & conditions are applicable to any order submitted via the site www.francetrialclassic.com France Trial Classic reserves the right to change these terms & conditions at any time. In this event, the current terms & conditions will be applied to each order. Any customer having submitted an order on Francetrialclassic.com is considered de facto to have accepted the current terms & conditions without restriction. 

2. Product presentation

Francetrialclassic.com may not be held liable for any possible mistakes in the product descriptions. Photographs are not part of the contract. 

3. Product availability

Our products are available as per available stock. If we are out of stock of one or more items you have ordered, francetrialclassic.com undertakes to: 

• Notify you by e-mail or telephone as soon as possible. 

4. Product price

The prices of our products are given in Euros and are inclusive of all taxes but not shipping costs. Prices may change at any time without notice. However, products will always be billed at the price in effect at the time of the order.

5. Ordering

There are four ways to order: 

• Internet, at www.francetrialclassic.com 

• Regular mail, by sending this order form (PDF) to our address: France Trial Classic, 9 rue François Dezort, 78490 Méré, France

• Telephone, by calling this number: +33 (0)7 76 30 35 78 (national call rate). An order is considered to have been submitted on francetrialclassic.com and the terms & conditions accepted once you click on the “Yes, I confirm my payment” or “I will pay by cheque” buttons. The data recorded by francetrialclassic.com and our secure payment processor constitute proof of the nature, content and date of the order. If an ordered product is unavailable, the customer will be informed as quickly as possible. (S)he will then be asked whether they wish to change the order or cancel it. Francetrialclassic.com reserves the right to refuse to honour a customer’s order if a previous order has not been fully or partially settled, or where there is dispute over payment. 

6. Payment

Two are three ways to pay for your order: 

• Credit card (Carte Bleue, Visa, MasterCard) 

• Cheque. In this case, the order will be shipped when the cheque is received. (only from france)

Until such time as a product has been paid in full, it remains the property of France Trial Classic. 

7. Shipping and delivery

All our orders are sent as a tracked package and insured for the maximum amount allowed by the Post Office. Beyond that amount, the purchaser is solely responsible in the event of the package being lost. However, in order to avoid this, if an order exceeds this amount we will try to split it up so as to increase the insurable value. The additional cost for this type of shipping will be borne by France Trial Classic. Francetrialclassic.com undertakes to ship the order within 48 working hours following the reception of your payment. If this proves impossible (items out of stock, etc.), the customer will be notified as quickly as possible. In the case of an order involving products with different shipping times, the shipping time will be that of the product with the longest shipping time, unless the purchaser instructs otherwise. In this case francetrialclassic.com reserves the right to send the order in multiple shipments. Delivery is to the address specified when the order is submitted. Francetrialclassic.com may not be held liable for delayed delivery, this being dependent upon an outside service provider. Any mistaken or missing necessary information in the delivery address or the customer’s identity relieves francetrialclassic.com of responsibility for the delivery. Francetrialclassic.com may not be held liable for non-delivery of a product due to it being out of stock or unavailable, nor for circumstances outside our control. Francetrialclassic.com therefore refuses any liability for any indirect damages: operating losses, loss of profit, loss of opportunity, damages, costs... In the case of a warehouse pick-up, our policy is as follows: 

• Pick-ups may be made by appointment only. 

For security reason, we will not ship to any PO Box address

8. Warranty and after-sales service

Most of our products are wear part spares; consequently, we are unable offer a guarantee. Despite this, after sales service is available if you receive new but defective goods. You may contact us by:

9. Complaints and returns

Our customer service is at your disposal. You may contact us by:

• Regular mail: France Trial Classic, 9 rue François Dezort, 78490 Méré, France Pursuant to the provisions of article L.121-16 of the French Consumer Code, you have 14 days from delivery of your order to return the item delivered for exchange or refund. However, the following conditions must be met: 

• Products must not have been opened 

• Returns must be made to our address: France Trial Classic, 9 rue François Dezort, 78490 Méré, France 

• Shipping costs have to be paid by the purchaser. But if you received a defective item or the wrong item compare to what you have ordered, the shipping cost will be paid by France Trial Classic

10. Sale abroad

The products we sell comply with French legislation. However, France Trial Classic may not be held liable if the products violate the legislation of a foreign country to which the products are delivered. It is the customer’s responsibility to check with local authorities on the possibility of importing or using the products or services (s)he wishes to order. 

11. Processing of personal and confidential data

Your personal information (identity, address, e-mail address, telephone number) are not sold or given to any third party without your consent. Francetrialclassic.com has submitted its declaration to the CNIL (National Commission on Information Technology and Freedom) under number 1137037. Our declaration to the CNIL guarantees your rights, which are fourfold: 

• The right to information 

• The right of opposition 

• The right of access 

• The right of rectification. You need only write to us or call us at +33 (0) 954 497 797 (national call rate) to exercise your rights. Like all e-commerce sites, francetrialclassic.com uses cookies. Cookies must be accepted by your browser in order to utilise francetrialclassic.com. These little text files contain data that are essential for processing your orders. They do not contain any personal data. In accordance with our secure payment policy, your payment information is not stored on our servers, nor known to any employee of France Trial Classic. 

12. Intellectual property

The texts, remarks, works, illustrations and images reproduced on the site francetrialclassic.com are reserved worldwide by copyright and intellectual property right. As such, and in accordance with the provisions of the Intellectual Property Code, only private use is authorised, subject to different and more restrictive provisions of said code. Any complete or partial reproduction of the site francetrialclassic.com is prohibited. 

13. Jurisdiction

These terms & conditions are subject to French law. The court of the district in which France Trial Classic has its registered office has sole jurisdiction over any dispute deriving from application of these terms and conditions, without excluding submission of the case by France Trial Classic to another competent jurisdiction 

14. SPECIFIC CONDITIONS REGARDING NOT OFFICIALLY CONFIRMED PRODUCTS

Utilization of not officially confirmed products for France and responsibility: Utilisation of not officially confirmed products and those which modified the initial motorcycle configuration are strictly reserved for competition or on private track, field or area. That product >must not be used on open roads. The buyer of those not officially confirmed spares will not be allowed to contest the fact that he has been informed of the not officially confirmed state of those products. All initial and original specification of each bike must stay original to have the right in France to drive on open traffic roads.The indirect utilisation by the buyer will not engaged France Trial Classic responsibility. Any consequences (Financial, legal, physical or non physical) will not to be assumed by France Trial Classic. The buyer will be the only responsible and accept to be the only responsible in case of non appropriate utilisation of such a product. For foreign countries: As it is impossible for France Trial Classic to list every country regulation, all customers abroad have to learn about his own regulation and low about the not officially French product and eve about all the officially French ones that may not be allowed to be used on open traffic road in their own country.
